Rules, Terms and Conditions
- All contracts of
membership shall become of full force and effect upon receipt by Landlords.co.za
of the membership application form and once the annual registration fee
has been deposited and cleared in their banking account;
- All members
undertake and agree that the contract of membership is concluded in
Somerset West on receipt of the membership registration form at the
registered office of Landlords.co.za as specified in clause 12 hereof.
- All contracts
downloaded from our website are for the use of the member only and may not
be republished or supplied to any non-members; members are only allowed to
use these contracts while their membership is active and upon expiry, may
not reproduce or use the contract or other documents supplied by
Landlords.co.za again
- Any articles
published on our website remain the property of Landlords.co.za and may
not be reprinted or distributed to any other person;
- All information
supplied by Landlords.co.za whether it be typed, printed or oral is
supplied in the strictest of confidence and is for the use of the member
only;
- Landlords.co.za endeavor
to ensure all information supplied by them is true and correct but do not
take responsibility for any errors that may occur;
- Members acknowledge
and agree that the information supplied to them by Landlords.co.za shall
be used exclusively for the purpose of assisting the member in it's bona
fide credit risk assessment and any other standard credit management
purpose;
- Members warrant
that they will not perform an enquiry on our data base or that of our
credit information supplier without obtaining the written consent of the
party to be investigated;
- Members undertake
to ensure that the details of any tenant that they report to Landlords.co.za
or to any national bureaus as defaulters and in arrears are accurate and
the member takes full responsibility for the supply of such information
and indemnifies Landlords.co.za for any claims in connection with the
supply of said information;
- Landlords.co.za
reserve the right to terminate the membership of any member in
circumstances where it has come to their attention that the member has
breached the rules of membership;
- In terms of Section
45 of Act 32 of 1944, as amended, the member hereby consents to the
jurisdiction of the Magistrate's Court of any district having jurisdiction
by virtue of Section 28(1) of the said Act, in respect of any legal
proceedings in connection with or arising from this membership agreement.
- Landlords.co.za hereby chooses as its
domicilium citandi et executandi Unit 15 Sauvignon
Park, Somerset West, Western Cape Province, or such alternative address as
the they may hereafter appoint here in writing.
TERMS AND CONDITIONS
All pro
forma contracts included on our website are supplied free of charge to members
with active memberships, however it is the responsibility of the member to
ensure that the correct form of lease is used for their particular situation,
and LANDLORDS.co.za shall not be responsible for any omissions in respect of
any lease. Furthermore that the LANDLORDS.co.za has no control over the details
of the parties and property thereafter inserted into a pro forma lease and
whether the lease is correctly completed, signed, witnessed and stamped.
LANDLORDS.co.za accept no responsibility for any lost rent
or damage to property occasioned by a lessee who has been screened by our
service, and accept no responsibility for inaccurate information supplied by
the national defaulters bureaus .
Information supplied to the member by LANDLORDS.co.za
regarding prospective tenants’ solvency, financial standing, legal status or
integrity shall not be construed as the opinion of Landlords.co.za but shall
directly reflect information supplied to Landlords.co.za by CPB, Experian and
the judicial system of South Africa.
